MINUTES

 

July 28, 2009

 

The regular meeting of the Council of the Township of Armour was held on Tuesday, July 28, 2009 at 7:30 p.m. Those in attendance were Reeve, Bob MacPhail; Councillors, Rod Blakelock, Jerry Brandt, Marty Corcoran, and Pat Hayes; Planner, Robert Miller, Municipal Planner Staff, Wendy Whitwell, Clerk Administrator.

 CONFIRMATION OF THE MINUTES OF THE PREVIOUS MEETING:

The minutes of the regular meeting on July 14, 2009 were approved as circulated.

The minutes of the closed meeting on July 14, 2009 were approved as circulated.

DECLARATION OF PECUNIARY INTEREST:  None

DELEGATIONS:     None

BUSINESS ARISING FROM A PREVIOUS MEETING:

 -         Access 2011, resolution in support of the submission made to council July 14, 2009 was passed.

APPLICATIONS: Consents

 -         B-010/09, B-011/09 and B-012/09 - 2055988 Ontario Inc. Part Lot 22, concession 10 (Lot 10 -Plan M-632)

          - planning report Tunnock Consulting reviewed

           Council deferred this item as requested.

APPLICATIONS: Site Plan Agreement

 -         Shelley/Burkholder -Concession 2, part Lot 7, resolution passed to authorize the planner to prepare the site plan agreement.

BY-LAWS:

 -         # 35-2009 being a by-law to renew the 9.1.1 Central Emergency Reporting Bureau agreement, was passed a first, second and third time.

 -         # 36-2009, being a by-law to confirm the proceedings of council at its meetings was read a first, second and third time.

REPORTS:

 -         Arena, no meeting to report

-         Bob reported on a meeting with Derek Miller regarding the funding agreement included in the agenda package.

-         Bob reported on a meeting with Mayor Jeff Johnston and Road Supervisors to discuss the road agreement proposed by Armour for Proudfoot Road.

CORRESPONDENCE:

 -         correspondence to North Bay Parry Sound Health Unit regarding water sample bottles.

 -         Haldimand County Disaster Relief Committee, request for donation was not supported.

 -         Town of Kearney, Notification of the Kearney Regatta July 31 - August 2, 2009 and request for donations was not supported.

 -         Ontario Municipal Knowledge Network, information on recent updates.

 -         Ministry of Government Services, information regarding Industry Canada funding to extend broadband coverage across Canada.

 -         Township of Woolwich, requesting a review an update of the Development Charges Act. A resolution in support was passed.

 -         Community Schools Alliance, information and resolution which was supported.

 -Huntsville District Memorial Hospital Foundation invitation to a summer garden party, Thursday, August 20, 2009.

 -         Almaguin Highlands O.P.P. Crime Stoppers Annual Golf Tournament. A resolution authorizing a donation was passed.

 -         Norm Miller Golf Tournament, invitation and information.

 -         MMM Group Limited, notification of the Filing of Design and Construction Report for Highway 11 four laning from .5 km North of Highway 520, Northerly 5.7 km. G.W.P. 473-93-00.

 UNFINISHED BUSINESS:

 -         Resolution to authorize the tendering of the Armour Municipal Office Building Improvements.

 -            staff report, access to high speed internet.

 -         Ontario Growth Plan, copy of submission

 -         Draft 2009 Council Fall Newsletter, approved with additions.

 -         Request for maintenance of road allowance, Concession 7, between lot 10 and 11. Reeve MacPhail will draft a response and forward to the clerk

NEW BUSINESS:

-         Draft agreement between the Township of Armour and 1653194 Ontario Limited  will be forwarded to Doug Christie for comments.

 -         Staff report, Municipal Alcohol Policy, a resolution was passed.

 -         Chetwynd Community Centre, staff report. The clerk was directed to contact Harvey Mulligan to cut the grass, hydro is to be disconnected, water will need to be drained this fall.

 -         Staff report, re-scheduling of September council meetings. Council will meet September 8th and 29th.

 -         Almaguin News, special advertising opportunities. Council did not approve these ads.

-         Paul Dickenson, request for use of the council room. No permission was granted.

 -         List of correspondence received and not on the agenda.

 RESOLUTIONS:

 -         Moved by Pat Hayes, Seconded by Rod Blakelock, That the Council of the Township of Armour hereby approve the minutes of the regular meeting held on July 14, 2009 as circulated. Carried

 -         Moved by Pat Hayes, Seconded by Rod Blakelock, That the Council of the Township of Armour hereby approve the minutes of the closed meeting held on July 14, 2009, as circulated. Carried

 -         Moved by Pat Hayes, Seconded by Rod Blakelock, That the Council of the Township of Armour hereby support the goals of ACCESS 2011 including the pursuit of funding to benefit and meet the needs of our community. We recognize these needs to include well equipped trade shops and multi-use trail projects. Carried

 -         Moved by Rod Blakelock, Seconded by Pat Hayes, That the Council of the Township of Armour have no objection to the application for consent # B-015/09 for a right-of-way , Concession 3 & 4, Lots 1 & 2, Township of Ryerson. Carried

 -         Moved by Pat Hayes, Seconded by Rod Blakelock, That the Council of the Township of Armour hereby authorize the site plan application submitted by Ted and Joan Shelley and Vicki and Gary Burkholder be forwarded to Robert Miller, Municipal Planner for the preparation of a site plan agreement. Carried

 -         Moved by Pat Hayes, Seconded by Rod Blakelock, That leave be given to introduce a bill # 35-2009, being a by-law to enter into an agreement with the Province of Ontario as represented by the Ontario Provincial Police for the provision of 9-1-1 Central Emergency Reporting Bureau (CERB) Services. Carried

 -         Moved by Pat Hayes, Seconded by Rod Blakelock, That By-law # 35-2009, be read a second time. Carried

 -         Moved by Pat Hayes, Seconded by Rod Blakelock, That by-law # 35-2009, be read a third time, signed and the seal of the Corporation affixed thereto and finally passed in open Council this 28th day of July, 2009. Carried

 -         Moved by Rod Blakelock, Seconded by Pat Hayes, That leave be given to introduce a bill # 36-2009, being a by-law to confirm the proceedings of Council at its meetings. Carried

 -         Moved by Rod Blakelock, Seconded by Pat Hayes, That By-law # 36-2009, be read a second time. Carried

 -         Moved by Rod Blakelock, Seconded by Pat Hayes, That by-law # 36-2009, be read a third time, signed and the seal of the Corporation affixed thereto and finally passed in open Council this 28th day of July, 2009. Carried

 -         Moved by Marty Corcoran, Seconded by Jerry Brandt, That the Council of the Township of Armour hereby support the resolution from the

Township of Woolwich and request the Ministry of Municipal Affairs to conduct a review of Chapter 27, Section 5 (2) of the Development Charges Act 1997 and make changes that would eliminate the requirement for municipalities to deduct grant funding received from eligible portion of development charges. Carried

 -         Moved by Jerry Brandt, Seconded by Marty Corcoran, That the Council of the Township of Armour hereby support the request from the Community Schools Alliance and petition the Province of Ontario to implement a “smart moratorium” on disputed school closings to provide an opportunity for the Ministry of Education, school boards and municipalities to work together to develop policies addressing such issues as planning for the declining enrollments, a mutual agreed upon Accommodation Review Committee process, a review of funding to rural and small community schools, and transparency and accountability between municipalities and school boards. Carried

 -         Moved by Jerry Brandt, Seconded by Marty Corcoran, That the Council of the Township of Armour hereby approve a donation in the amount of $ 100.00 to the Near North Crime Stoppers annual fund raising event. Carried

 -         Moved by Marty Corcoran, Seconded by Jerry Brandt, That the Council of the Township of Armour hereby approve the tendering of the Armour Municipal Office Building Drainage Improvement Project as detailed. Carried

 -         Moved by Jerry Brandt, Seconded by Marty Corcoran, That the Council of the Township of Armour hereby approve the draft 2009 Fall Council Newsletter as proposed, with additions. Carried

 -         Moved by Marty Corcoran, Seconded by Jerry Brandt, That the Council of the Township of Armour hereby amend By-law # 9-2003, the Municipal Alcohol Policy, Regulation #14 - Insurance, by increasing the insurance requirement to read a minimum of 5 million dollars in liability insurance on which the Township is named insured. Carried

 -         Moved by Jerry Brandt, Seconded by Marty Corcoran, That the Council of the Township of Armour hereby change the regularly scheduled council meeting of September 22nd to September 29th, 2009. Carried

 -         Moved by Jerry Brandt, Seconded by Marty Corcoran, That the Council of the Township of Armour hereby move into closed session at 9:47 p.m as per Section 239 (2) (c) (e) (f) of the Municipal Act, pending acquisition or disposal of lands; litigation or potential litigation, advice that is subject to solicitor-client privilege. Carried

 -         Moved by Jerry Brandt, Seconded by Marty Corcoran, That we do now adjourn this closed session at 9:53 p.m. Carried

 -         Moved by Jerry Brandt, Seconded by Marty Corcoran, That we do now adjourn this regular meeting at 9:55 p.m. until the next regular meeting of Council scheduled for August 11, 2009 at 7:30 p.m. or at the call of the Reeve. Carried
